Matrimonial & Family Team:
Our team offers an unparalleled breadth and depth of experience and is considered the “go-to” team in all matters related to matrimonial and family law. We are sensitive to the difficult and stressful times that our clients are experiencing and do all we can to guide our clients through the difficulties of matrimonial breakdown efficiently and competently.

We regularly provide advice on all areas touching on matrimonial and family law matters including divorce, financial settlement between spouses, custody and access issues, maintenance for spouses and children. We are skilled in drafting domestic contracts including pre-nuptial contracts, nuptial settlements and separation agreements. Our attorneys are experienced and effective advocates who appear in all levels of Court in Bermuda. FAQ
How long do I have to be married before I can apply for a divorce in Bermuda?

Under the Matrimonial Causes Act, you must generally be married for at least three years before filing for divorce, unless you can prove exceptional hardship or depravity.

Does Bermuda have "no-fault" divorce?

Yes. Since the 2022 amendments, Bermuda has shifted to a no-fault system. You no longer need to prove adultery or "unreasonable behavior"; a statement that the marriage has irretrievably broken down is sufficient

How is child maintenance calculated?

Unlike some jurisdictions, Bermuda does not use a rigid formula or "table." The Court has wide discretion and considers the child's needs, the parents' respective incomes, and the standard of living the child enjoyed during the marriage

I just paid off my mortgage; do I automatically own my home?

Not quite. In Bermuda’s current system, you must ensure a Deed of Reconveyance (for freehold) or Deed of Reassignment (for leasehold) is executed. Without this, the legal title technically remains with your lender.

Are there inheritance taxes in Bermuda?

Bermuda does not have a formal inheritance or death tax. However, Stamp Duty is payable on the value of the deceased’s Bermuda-situs assets (like local real estate or bank accounts) at the time of probate.

Do I need a "Living Will" in Bermuda?

While often called a "Living Will," these are legally referred to as Advanced Directives. They are highly recommended to ensure your medical preferences are respected if you become unable to communicate.

Can I recover my legal fees if I win a court case?

Generally, "costs follow the event" in Bermuda, meaning the loser pays a portion of the winner's legal fees. However, this is usually taxed costs (around 60–70% of actual spend) and is at the Court's discretion.

What is a "Tomlin Order"?

This is a common court order used in Bermuda to settle a case confidentially. The public court order stays the proceedings, but the specific settlement terms are kept in a private schedule known only to the parties.

Can an employer terminate an employee "at will" in Bermuda?

No. Under the Employment Act 2000, an employer must have just cause for termination (e.g., misconduct, redundancy, or poor performance) and must follow fair procedures to avoid unfair dismissal claims.
